Mediation and ADR
Finding ways to settle a dispute outside the Court is becoming more and more important. It is not only the issue of costs of litigation but also a question of seeking a more flexible settlement solution than is sometimes available from the Court. In any event, the Court rules penalise parties who do not consider and, where appropriate, use mediation or alternative dispute resolution ("ADR").

Mediation is a non-binding process designed to get the parties together and to assist in reaching a negotiated settlement. More often than not, mediations are successful. Other forms of ADR include arbitration. An arbitrator's award is binding on the parties, but the identity and experience of an arbitrator can be agreed between the parties. For example, this could be a professional such as a chartered surveyor or chartered accountant.
